These Terms of Service ("Terms") govern your use of the DawaiiX platform, operated by DawaiiX Pvt. Ltd. ("DawaiiX", "we", "us", or "our"). By creating an account or using the platform, you agree to these Terms.
1 The Platform
DawaiiX is a business-to-business exchange for the pharmaceutical trade. It connects registered pharmacies, distributors, and wholesalers ("Exchangers") to browse a shared catalogue, negotiate prices directly with each other, place orders, and list their own stock for sale. DawaiiX facilitates these transactions between exchangers — it is not itself a party to the underlying sale of goods between buyer and seller exchangers.
2 Eligibility & Registration
- You must be a licensed pharmacy, distributor, or wholesaler authorized to trade in pharmaceutical products under applicable Indian law.
- A valid Drug License number is required to register and is verified as part of account creation.
- You are responsible for the accuracy of the information you provide, and for keeping your login credentials confidential.
- DawaiiX may suspend or terminate accounts that provide false registration information or violate these Terms.
3 Orders, Negotiations & Pricing
- Prices shown are set by the individual exchanger listing that item, not by DawaiiX.
- Negotiation and order confirmation happen directly between the buying and selling exchanger through the platform's tools.
- Once an order is placed and accepted, both parties are responsible for fulfilling their side of that transaction — supplying the goods as described, and paying/accepting delivery as agreed.
- DawaiiX does not guarantee the quality, authenticity, or regulatory compliance of goods listed by exchangers — that responsibility rests with the listing exchanger, who must ensure all products they sell are properly licensed, sourced, and stored.
4 Acceptable Use
You agree not to:
- List or sell counterfeit, expired, or improperly sourced pharmaceutical products.
- Misrepresent your identity, licensing status, or the products you list.
- Use the platform to circumvent applicable drug control, pricing, or trade regulations.
- Attempt to access another exchanger's account or data without authorization.
5 WhatsApp & Communications
DawaiiX may communicate with you via WhatsApp, email, or in-platform notifications regarding your account, orders, and negotiations, processed in accordance with our Privacy Policy.
6 Limitation of Liability
DawaiiX provides the platform "as is" and is not liable for disputes, losses, or damages arising directly between exchangers from a transaction conducted through the platform, except where required by applicable law. Nothing in these Terms limits liability that cannot be limited under Indian law.
7 Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the platform after a change constitutes acceptance of the updated Terms.
